Amendments to BVI Legislation – Statutory Fees

The British Virgin Islands (BVI) has recently updated its Financial Services Fees regime. The newly enacted Financial Services (Fees) (Amendment) Regulations 2023 will replace its predecessor the Financial Services (Fees) Regulations 2010 and will come into force on 1 April 2023. This circular sets out the changes to fees which may affect your licenced entities including funds and approved managers:

Application

• The government application fee for private fund, private investment fund, and professional fund applications will increase from US$700 to US$850.
• The government application fee for an incubator fund will increase from US$1500 to US$1800.
• The government application fee for approved manager application will increase from US$1000 to US$1200.
• The government application fee for an investment manager application will increase from US$1000 to US$1200.

Renewal

• The government renewal fee for private fund, private investment fund, and professional fund will increase from US$1000 to US$1200.
• The government renewal fee for an incubator fund will increase from US$1000 to US$1200.
• The government renewal fee for approved manager renewal will increase from US$1500 to US$1800.
• The government renewal fee for an investment manager renewal will increase from US$1500 to US$1800.

Other Fees

• The government fee for the issuance of a certificate of fund status for incubator fund and approve fund will increase from $150 to $200.

英屬維京群島法律之修正 – 法定費用變更

英屬維京群島（BVI）於近期更新了金融服務費的收費方式。新制定的《2023年金融服務（費用）（修正）條例》將於2023年4月1日生效並取代現行《2010年金融服務（費用）條例》。新條例的連結如下：

2023年金融服務（費用）（修正）條例

新條例對BVI商業實體（包括基金以及其經理人）金融服務的費用收取，變更如下：

申請費用

• 設立私募基金、私募投資基金和專業投資基金的法定申請費用自700美元調升至850美元。
• 設立孵化基金的法定申請費用自1,500美元調升至1,800美元。
• 註冊基金經理人的法定申請費用自1,000美元調升至1,200美元。
• 註冊投資經理人的法定申請費用自1,000美元調升至1,200美元。

續期費用

• 私募基金、私募投資基金和專業投資基金的法定續期費用自1,000美元調升至1,200美元。
• 孵化基金的法定續期費用自1,000美元調升至1,200美元。
• 基金經理人的法定續任費用自1,500美元調升至1,800美元。
• 投資經理人的法定續任費用自1,500美元調升至1,800美元。

其他費用

• 向政府申請孵化基金和核准基金之基金現況證書的法定費用自150美元調升至200美元。
