BVI Government Fees

The BVI Government has announced that with effect from 1 September 2018, the maximum government penalty for the late filing of the Register of Director (ROD) has been reduced from US$8,000 to US$5,000.

The Government’s Order further provides:

• that the maximum penalty shall be treated as if it were US$5,000 from the date the penalty became applicable (therefore giving retroactive effect to the US$5,000 penalty);

• where a penalty above US$5,000 was previously paid, a refund of the difference between the amount paid and $5,000 shall be issued; and

• Where an existing company fails to file a copy of the Register of Directors on or before 31 December 2018, the Registrar may strike the name of the company off the Register.

For those companies that have not yet filed their ROD, please let us have your instructions, your completed register for filing, the penalty and filing fee of US$5,050 and administrative fee of US$125 no later than 7 December 2018. Due to the administrative time and resources required to file a Register, Portcullis will not be held responsible for any consequences or costs that might arise as a result of receiving a Register for filing later than 7 December 2018.

Note: Please ignore this message if the Register of Directors for your company has already been filed with the BVI Registry.

英屬維京群島政府費用

英屬維京群島政府已宣布，自2018年9月1日起，因延遲歸檔董事名冊所處以最高政府罰金已自美元8,000元降為美元5,000元。

政府命令進一步規定如下：

•最高罰金應自罰金適用之日起即視為美元5,000元(因此美元5,000元罰金具有追溯效力)。
•之前已繳納罰金超過美元5,000元者，應退還已付金額與美元5,000元之間的差額。
•公司截至2018年12月31日為止尚未歸檔董事名冊者，註冊處得將該公司除名。

尚未歸檔董事名冊的公司，最遲請於2018年12月7日，向本公司傳達貴公司指示、送交供歸檔貴公司完整董事名冊與政府罰金暨歸檔費美元5,050元及行政費美元125元。鑒於歸檔董事名冊所需的行政時間與資源，本公司於2018年12月7日後始接獲供歸檔的董事名冊者，對其所致之任何後果或費用概不負責。

後記：若貴公司的董事名冊業已於英屬維京群島註冊處歸檔，則毋須理會本項訊息。
