Cayman Enforcement Guidelines Issued

The Department for International Tax Cooperation (DITC) advises industry that Enforcement Guidelines in respect of the Common Reporting Standard (CRS) and Economic Substance (ES) frameworks notice issued on 31 March 2022 by the Tax Information Authority, will begin enforcement actions in the coming weeks.

The CRS Enforcement Guidelines and the ES Enforcement Guidelines set out the Authority’s principles and processes for taking enforcement actions and penalties in the coming weeks to address non-compliance with CRS and ES frameworks, and apply to all persons within the scope of the Authority’s compliance monitoring and enforcement powers to those have failed to submit the relevant reporting within the stipulated timeframe.

Both Guidelines should be read in conjunction with the CRS Regulations and the ES Act, which are available on the DITC website.

國際稅賦合作處通知業界，稅賦資訊主管機關已於2022年3月31日公告有關共同申報準則及經濟實質的施行細則架構，將於未來數週內開始施行。

針對未遵守共同申報準則及經濟實質架構者，共同申報準則施行細則及經濟實質施行細則說明了主管機關在未來數週內將採取施行措施及懲處的原則及程序，適用於屬於主管機關法遵監測及施行權限範圍內的所有人，並適用於未在規定期限內提交相關申報的人。

上述兩項施行細則，應與國際稅賦合作處網站上的共同申報準則辦法及經濟實質法合併閱讀。
